These General Terms and Conditions (“Terms”) apply to purchases made through the online store available at https://www.srsbooks.com (“Website”).

The online store trades under the name SRS Books / Sivarama Swami Books (“SRS Books”, “we”, “us”, or “our”).

By placing an order through the Website, you agree to these Terms. These Terms do not limit any mandatory consumer rights that apply to you under EU or Hungarian law.

1. Scope of these Terms

These Terms apply to the sale of books, publications, and related products offered through the Website.

The Terms apply mainly to consumer purchases. A “consumer” is a natural person acting outside their trade, business, craft, or profession.

If you purchase on behalf of a business, organisation, or institution, some consumer-specific rights, including the statutory right of withdrawal, may not apply.

2. Products and product information

We aim to describe all products as accurately as possible, including title, author, format, language, price, and availability.

Product images are for illustration purposes. Minor differences in cover appearance, edition, packaging, or printing may occur.

Availability shown on the Website is not a guarantee that the product will remain available until your order is accepted.

3. Prices, taxes, and delivery costs

Prices are shown on the Website in the currency displayed at checkout.

Prices include applicable taxes unless stated otherwise. Delivery costs, if any, are shown before you place your order.

For international orders, you may be responsible for customs duties, import VAT, handling charges, or other charges imposed by your country. These charges are not controlled by us and are not included in the product price unless expressly stated at checkout.

4. Orders and contract formation

You can place an order by adding products to your cart and completing the checkout process.

Before submitting your order, you will have the opportunity to review and correct your order details.

After you place an order, we may send an order confirmation email. This confirms that we have received your order. The sales contract is formed when we accept the order or dispatch the ordered products, whichever occurs first.

We may refuse or cancel an order where:

  • the product is unavailable;
  • there is an obvious pricing or product-information error;
  • payment is not authorised;
  • delivery is not possible to the address provided;
  • the order appears fraudulent or abusive;
  • we are legally required to refuse the order.

If payment has already been taken for a cancelled order, we will refund the relevant amount.

5. Payment

Available payment methods are shown at checkout.

Payments may be processed by third-party payment providers. We do not store full payment card numbers or card security codes.

Your order may not be processed until payment is authorised or received.

6. Delivery

Delivery options, estimated delivery times, and delivery costs are shown at checkout where applicable.

Unless we agree otherwise with you, we will deliver the products without undue delay and no later than 30 days after the contract is formed.

If delivery is delayed, we will inform you where possible. If we cannot deliver within the agreed time, you may be entitled to cancel the order and receive a refund in accordance with applicable law.

Risk of loss or damage passes to you when you, or a person nominated by you, receives the products. If you arrange your own carrier independently, risk may pass when the products are handed to that carrier.

Please ensure that your delivery address is complete and accurate. We are not responsible for delays or failed delivery caused by incorrect or incomplete delivery information provided by you.

7. Right of withdrawal for consumers

If you are a consumer in the European Union, you normally have the right to withdraw from an online purchase within 14 days without giving any reason.

The withdrawal period expires 14 days after the day on which you, or a person nominated by you, receives the products.

To exercise your right of withdrawal, you must inform us by a clear statement, for example by email.

8. Effects of withdrawal

If you withdraw from the contract, we will refund the payments received from you for the returned products, including the standard delivery cost charged for the original delivery, if applicable.

We may withhold the refund until we have received the returned products or until you provide proof that you have sent them back, whichever is earlier.

Refunds will be made using the same payment method you used for the original transaction, unless we agree otherwise. You will not be charged a fee for the refund.

You must send back the products without undue delay and no later than 14 days after informing us that you wish to withdraw.

Unless we have agreed to pay the return cost, you are responsible for the direct cost of returning the products.

You are responsible for any reduction in value of the products caused by handling them more than necessary to establish their nature, characteristics, and functioning.

9. Exceptions to the right of withdrawal

The right of withdrawal may not apply in certain cases permitted by law, including:

  • sealed audio, video, or software products once unsealed after delivery;
  • digital content that has begun to be supplied with your prior express consent and acknowledgement that you lose the right of withdrawal;
  • products made to your specifications or clearly personalised;
  • products that are not suitable for return for health or hygiene reasons and were unsealed after delivery;
  • other cases where applicable law excludes the right of withdrawal.

For ordinary physical books, the standard 14-day withdrawal right usually applies unless a legal exception applies.

10. Returns condition

Returned products should be sent back in a clean, complete, and reasonably protected condition.

You may inspect the product as you would in a physical shop, but you should not use or damage it. If the product is returned damaged or with signs of use beyond necessary inspection, we may deduct the reduced value from the refund where permitted by law.

11. Faulty, damaged, or incorrect products

If a product arrives damaged, faulty, incomplete, or different from what you ordered, please contact us as soon as possible at books@sivaramaswami.com.

Please include your order number, a description of the issue, and photos where helpful.

Consumers have statutory rights under applicable law, including the legal guarantee of conformity for goods. These rights may include repair, replacement, price reduction, or refund, depending on the circumstances. Nothing in these Terms limits your mandatory legal guarantee rights.

12. Refunds and exchanges outside the statutory withdrawal right

Where the statutory right of withdrawal does not apply, or where the withdrawal period has expired, we may still consider refund or exchange requests at our discretion.

This does not affect your statutory rights for faulty, damaged, or incorrectly supplied products.

13. Accounts

You may be able to create an account on the Website.

You are responsible for keeping your login details secure and for all activity under your account.

We may suspend or close an account if it is used fraudulently, unlawfully, abusively, or in breach of these Terms.

You may contact us if you wish to close your account.

14. Acceptable use of the Website

You agree not to misuse the Website. In particular, you must not:

  • use the Website for unlawful purposes;
  • interfere with the security or operation of the Website;
  • attempt to gain unauthorised access to the Website, accounts, or systems;

19. Limitation of liability

We are responsible for foreseeable loss and damage caused by our breach of these Terms or our negligence.

We do not exclude or limit liability where it would be unlawful to do so, including liability for fraud, intentional misconduct, death or personal injury caused by negligence, or mandatory consumer rights.

To the extent permitted by law, we are not responsible for:

  • indirect or consequential loss;
  • loss caused by your misuse of the Website;
  • delays or failures caused by events outside our reasonable control;
  • business losses where you are not acting as a consumer.

Nothing in these Terms limits your statutory rights as a consumer.

20. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, including natural disasters, war, strikes, transport disruption, postal or courier delays, technical outages, cyber incidents, supplier delays, changes in law, or other force majeure events.

If such an event affects your order, we will try to inform you and take reasonable steps to minimise the effect.

22. Consumer dispute resolution

If you are a consumer and a dispute cannot be resolved directly with us, you may have the right to contact a competent Hungarian conciliation board.

23. Governing law and jurisdiction

These Terms are governed by the laws of Hungary.

If you are a consumer, this does not deprive you of any mandatory consumer protections available under the law of your country of residence.

Disputes may be submitted to the competent courts under applicable law. Consumers may also have access to consumer dispute-resolution bodies as described above.

24. Changes to these Terms

We may update these Terms from time to time to reflect changes in our business, services, legal requirements, or Website functionality.

The updated version will be posted on the Website with a new “Last updated” date.

The Terms in force at the time you place an order will apply to that order.
